Resolution’s Good Divorce Week shines a light on how families can separate in a more positive, respectful way. This year’s campaign focuses on helping separating couples avoid unnecessary conflict and find constructive solutions without relying on the already overstretched family court system.

What is Resolution and Good Divorce Week?

Resolution is a national community of family law professionals who are dedicated to helping people resolve issues in a constructive, non-confrontational way. Members of Resolution include solicitors, barristers, mediators and other family law experts who all follow a strict Code of Practice that promotes cooperation, respect and solutions that protect everyone involved, especially children.

Each year, Resolution hosts Good Divorce Week, a nationwide awareness campaign that encourages separating couples to consider more positive and collaborative ways of dealing with divorce and separation. The week highlights the challenges facing the family courts and promotes the benefits of working with Resolution members who can help families reach agreements without going to court. It’s also an opportunity to spread the word about options such as mediation and collaborative law — practical routes that often are used to assist in saving time, reducing stress and protecting family relationships.

Why families need a better way to separate

Across England and Wales, the family courts are struggling with delays and backlogs. It is understood that thousands of new cases start in the family courts every week. It might be that many of these could be resolved outside of court, through communication, cooperation and guided legal support.

Taking an adversarial approach to divorce can make matters worse. Aggressive letters, point scoring and unnecessary court proceedings can increase tension, prolong disputes, and drive-up legal costs. More importantly, they can make it harder for families to move forward and for parents to co-parent effectively in the future.

Thanks to Resolution’s campaigning, the introduction of no fault divorce in 2022 removed the need to assign blame when applying for divorce. This simple but vital change has allowed separating couples to focus on practical arrangements rather than apportioning fault and this is felt to reduce tension from the very start.

When separation is handled constructively, it is felt that families benefit in several ways, such as children being less likely to be affected by ongoing conflict. In addition, financial settlements might be able to be reached faster and more amicably. The aim is for both parties to be able to move on with their lives feeling more in control, less burdened, and ready to focus on the future.
