National Conveyancing Week: Report

It’s National Conveyancing Week and our Conveyancing team have each written a blog to explain their role in your property transaction.

Next, we come to the report on title for the property. Before we go into details about the report here is a brief overview of our conveyancers.

When a file is opened, it will be allocated to either Alex, Amy or Rhiannon, who will have responsibility for the transaction and overall conduct and control of the matter. We will be the main point of contact and able to answer any questions you may have throughout the transaction.

We have a combined experience of over 30 years in conveyancing practice and in that time, we have completed thousands of sales and purchases for clients. 

Once the draft contract paperwork is received and we have your authority to proceed with searches we will review the title documentation and property questionnaires completed by the sellers together with any supporting documentation. We will check whether the property benefits from adequate rights and whether any onerous rights and covenants are registered against the title of the property, which would affect your proposed use and enjoyment of the property. We will also raise any necessary initial enquiries with the seller’s solicitor. Such enquiries will include whether the seller obtained necessary planning permission and building regulations for any works carried out to the property and whether consent was obtained in accordance with any regulations on the title, known as  restrictive covenants. There may also be restrictions in the register that we will need to satisfy in order to ensure that we can register the property in to your name.

At this stage we will also send a draft Transfer to the seller’s solicitor for approval.

Once the search results and replies to enquiries are received, we will be in a position to finalise the report on title. This will explain to you all the information we have received and the key documents for you to sign, The Contract, Transfer and SDLT form.

In the report you will find details of rights for the benefit of the property as well as rights that are reserved for neighbouring properties, covenants and restrictions, the results of the searches that we have had carried out as well as any other relevant information and advice on your purchase.  This report is bespoke and tailored to each individual client and matter.

Once we have received your signed documents and satisfactory replies to enquiries from the seller’s solicitor, we will complete a detailed check of the file and sign it off in readiness for exchange. As part of this process, we would ensure that any lender requirements have been satisfied.
