Understanding Conveyancing Costs When Buying or Selling a Home | Nash & Co Solicitors

Conveyancing fees have historically been set at a fixed rate and the fees are considerably competitive compared to other areas of law, where solicitors and other legal professionals are able to change by a set hourly rate, based upon the number of hours that they work on a file.
In conveyancing, firms charge a set fee based upon the value of the property, with additional charges made in certain circumstances, for example if a property is leasehold, part of a shared ownership arrangement or if there is a freehold management arrangement, or if the property is newly built or if built within the last 10 years. In these instances, further work will be required to be undertaken by your solicitor or conveyancer in reviewing the title of the property and reporting to you upon these additional arrangements.
At Nash and Co Solicitors, we are committed to being transparent with our fees at the outset, so that you are fully aware of the charges that will be payable as part of your conveyancing transaction, including any such additional charges payable.
We appreciate that our clients want to know from the outset how much they will need to pay us for their transaction on completion. Our clients will therefore receive a quote to cover all anticipated fees and disbursements before instructing us to deal with their transactions. This quote will be specific to the property and will either be based upon our fixed fee scale or bespoke, depending upon the type and value of the property. This comprehensive quote ensures that our clients are able to budget for these costs without any hidden surprises, allowing our clients to then focus on the other arrangements, such as removal costs, buildings insurance and utilities.
To assist our clients, we have prepared the following answers to frequently asked questions regarding our fees;
Will the fixed fee quoted change?
We always seek to ensure that our initial quote includes all foreseeable fees, however there are of course some instances where we will need to increase our charges beyond our initial quotation, however this does not generally occur and only when there is an issue identified within the title of the property that we have noted as part of our searches and title investigations. We will of course immediately notify you if we identify that additional fees will need to be charged.
I’ve had a quote elsewhere that is cheaper, will you match this?
In short, it depends whether this quote is in line with our fee scales. We are confident in the service offered to our clients and therefore we will not generally price match.
We regularly undertake market research to ensure that our fees are in line with our competitors in the area. We don’t aim to be the cheapest as we are confident in the service levels we deliver by our highly regarded conveyancers and support team. Our clients will be provided with their conveyancer’s direct dial and contact details of their assistant. We therefore know that when our clients call the firm, they will always be able to speak to their conveyancer or someone in the team that will be able to assist with their queries. No unanswered calls or voicemails. Equally, we know that if you email the team, you will receive a prompt response.
At Nash & Co Solicitors we also monitor the number and type of new files that each conveyancer in the team takes on each month, to ensure that our clients aren’t just a number or another file at the bottom of a "to do pile". We are committed to offering our clients outstanding service and reliability, so that our clients get their transaction completed as comprehensively as possible and within a reasonable time frame, thereby giving our clients value for money. Whilst this may not be the cheapest quote the client receives, we receive regular feedback from our clients expressing their gratitude for the high standards of service they receive and recommending us to their family and friends.
Do you offer a "no completion no fee" scheme?
This isn't a scheme we currently offer at Nash & Co Solicitors, as we wish to ensure that all our clients that we represent are committed to their transactions. We do, however, appreciate that circumstances change or issues arise which cause clients to withdraw from their transactions, so we are flexible with any charges made if a transaction does not proceed. For example, we will only charge a proportion of our fixed fee, based upon the stage of the transaction when it goes abortive. We will also always discuss any proposed abortive fees with our clients before raising a bill.
What are disbursements?
These are third party costs payable as part of the conveyancing procedure, which are separate to the legal fees charged by Nash & Co Solicitors for carrying out the work on your behalf. For example, on a purchase you will be required to pay the following disbursements; electronic ID checks, searches and Land Registry searches, documents and registration fees. At Nash & Co Solicitors we do our utmost to estimate the cost of all disbursements at the outset of a transaction and include these within your quotation, however as these are third party costs, there are some aspects we cannot account for without our initial fee quotation, such as landlord/management pack fees and notices. The cost of these vary and are determined by the individual third party. We will of course notify you of the cost of any additional disbursements payable by you as soon as we become aware of these.
What is not included in our initial quotation?
You will be required to arrange and pay for your own survey and any mortgage valuation, as a separate expense. In addition, if you own or are buying a leasehold property, the landlord or management company are likely to charge you separate fees for any necessary management packs and notice fees.
What do I need to pay on account?
We ask all clients to make an initial payment on account at the outset of the transaction. On a purchase, this will be £400.00 due to the cost of the third party search disbursements. On a sale, this will be £200.00. Once your file is set up, we will provide you with our firm’s bank details to enable you to make payment on account by bank transfer or card payment, either over the phone or in person. This initial payment will be accounted for on our final completion statement and this will be deducted from our total legal costs and disbursements on completion.
When is the balance payable and when will I know where and when to pay this?
Once we are nearing towards exchange and completion, we will provide you with a completion statement, which will incur a full breakdown of the legal fees and disbursements payable by you on completion and taking into account all payments made by you on account and any mortgage loan to be received from your lender. Your completion statement will state the balance due from you to complete and we will discuss with you at this stage when this balance will need to be paid by you.
Once your file is initially set up, you will have been provided with our firm’s bank details to enable you to pay the final balance by bank transfer or card payment. We will never change our bank details during the course of your transaction, so payment should be made to the client bank details provided to you at the outset of the transaction and within our hard copy correspondence, however we are always happy to confirm these with you again before sending funds.
What is a referral fee?
A referral fee is a fee payable to an estate agent or mortgage broker for referring a client to this firm. You will be notified by this third party if they expect to receive a referral fee in return for referring your transaction to this firm and this will also be confirmed without our terms of business. Payment of a referral fee to a third party does not have any impact or affect upon the fee scale charged to our clients.
